Mark Cantor resolves Jefferson County Jury Trial

Mark Cantor successfully settled his automobile collision set for trial for Wednesday, June 13, 2012 in Jefferson County on the evening of June 12, 2012. This was an accident caused by a woman crying while driving. The defendant did not see a red light and ran through the red light striking our client. The reason the defendant was crying was that she had just dropped her brother off at a military base to be deployed to another state. The reason she was crying is not relevant to the case and I successfully had that rule opined by the Judge, and that the Jury would not be allowed to hear why the defendant was crying, but rather just that she was crying. Early in the case, the defendant made what is called an offer of judgment. An offer of judgment says that they will agree to pay a judgment or an award of a certain amount. If the defendant then is able to secure a verdict of less than the offer of judgment, the plaintiff must pay the taxable costs to the defendant. Taxable costs are things like the filing fee, service fee, deposition transcript costs, but not expert expenses, copies, etc... If the plaintiff is able to secure more than the offer of judgment, then the defendant must pay the plaintiff's taxable costs of the filing fee and deposition transcripts. In this case, I was able to secure nearly seven times the offer of judgment made early in the case. Although this was a soft tissue injury case and we had some other factors involved, receiving seven times the original offer of judgment is a significant victory in a conservative venue.
