Civil Lawsuits, Workers’ Compensations and Subrogation

Civil Lawsuits, Workers’ Compensations and Subrogation

At Cantor and Associate, we aggressively pursue our client's injury claims. We use an intellectual approach and apply our education, knowledge and skills accumulated over 2 decades of practice as well as our own research. Due to the fact that Gary and I have been successfully practicing for so long, we are now seen as authorities in many areas of personal injury litigation. Although we primarily handle Automobile cases, Wrongful Death and Medical Malpractice, we also handle Missouri Workers' Compensation claims.

One of the things that frequently occur from a work injury is that a third party is also liable. For instance, if someone is working and is involved in an automobile collision they may have a workers' compensation claim as well as a civil lawsuit. In order to properly handle that type of fact scenario, you need a well trained and well educated attorney.

One of the pitfalls of handling a workers' compensation claim and a civil cause of action is a concept of the law called subrogation. Subrogation is the idea that you would have to repay some of the money that you would win from the automobile collision back to the workers' compensation carrier. I have co-authored an article on this topic called Workers' Compensation Subrogation which was published in the journal of the Missouri Bar. I have also taught many other lawyers how to practice Missouri Workers' Compensation. Missouri lawyers are required to complete continuing legal education. As part of that continuing legal education I taught a course of other lawyers for an entire day and published a book called Worker's Compensation Hearings in Missouri Trial Techniques and Strategies. It is a long book, but if you are interested attached is a link.
